Welcome to Family Garden! These Terms of Service ("Terms") govern your use of the Family Garden mobile application and related services (collectively, the "Services") provided by Family Garden, Inc. ("we," "our," or "us"). By using our Services, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you don't agree to these Terms, please don't use our Services. You represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Apple App Store Terms

The Family Garden app is distributed through the Apple App Store. Your use of the app is also subject to Apple's Standard EULA and Privacy Policy. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the app through the Apple App Store.

3. Description of Services

Family Garden provides a wellness application that tracks walking activity and rewards users with virtual garden elements. Our Services include step tracking, garden growth mechanics, family sharing features, and related tools designed to encourage gentle physical activity.

4. Account Registration

• You must provide accurate and complete information when creating an account.
• You're responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• One person may not maintain more than one free account.

5. Acceptable Use

You agree NOT to:

• Use the Services for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any accounts or systems
• Use automated tools to interact with our Services without permission
• Share content that is offensive, harmful, or violates others' rights
• Impersonate any person or entity
• Interfere with or disrupt the integrity or performance of our Services

6. Virtual Items and Garden Elements

• All garden elements, themes, plants, and decorations ("Virtual Items") are virtual goods with no real-world value.
• Virtual Items are licensed to you for personal, non-commercial use within our Services.
• You don't own Virtual Items—they remain the property of Family Garden.
• Virtual Items cannot be transferred, sold, or exchanged for real money.

7. Health and Wellness Disclaimer

Family Garden is a wellness tool, not a medical device. The step tracking and garden features are not intended to diagnose, treat, cure, or prevent any health condition. Always consult with a healthcare professional before starting any exercise program. If you experience pain, dizziness, or other symptoms while walking, stop immediately and seek medical attention.

8. Intellectual Property

We own all right, title, and interest in the Services, including all content, designs, graphics, logos, and software. You may not copy, modify, distribute, or create derivative works based on our Services without our written permission.

9. Third-Party Services

Our Services may integrate with third-party services like Apple Health and Google Fit. Your use of those services is governed by their own terms and privacy policies. We don't control and aren't responsible for third-party services.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct we deem harmful to our community. You may also delete your account at any time. Upon termination, your right to use the Services ceases immediately.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILY GARDEN IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

12. Indemnification

You agree to indemnify and hold harmless Family Garden and its officers, directors, and employees from any claims, damages, or expenses arising from your violation of these Terms or your use of the Services.

13. Modifications to Terms

We may modify these Terms at any time. We'll post changes on this page with an updated "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
